Terms and Conditions of Sale



1. Our acceptance of your order will take place when i) we write to you to accept it (exclusive of VAT) and ii) we tell you that we are able to provide you with the product, which we will also confirm in writing to you, at which point a contract will come into existence between you and us.

2. If we are unable to accept your order, we will inform you of this and will not charge you for the product.

3. The images of the products in our brochure or on our website or in any other promotional materials are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device's display of the colours or the printed pictures in our brochure accurately reflects the colour of the products. Your product may vary slightly from those images.

4.Your rights to make changes. If you wish to make a change to the product you have ordered, please contact us. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of the product, the timing for delivery or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.

5.We are not responsible for delays outside our control. If our delivery of the products is delayed by an event outside our control, then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.

6.Your legal rights if we deliver late. You have legal rights if we deliver any products late. Delivery is usually within 5-7 working days, some of our specialist products (sofa’s, furniture, etc) are delivered by a specialist courier, please allow up to 6 to 12 weeks. If we miss the delivery deadline for any products, then you may treat the contract as at an end straight away if any of the following apply;
i) we have refused to deliver the products,
ii) delivery within the delivery deadline was essential (taking into account all the relevant circumstances),
iii) you told us before we accepted your order that delivery within the delivery deadline was essential.

7. When you become responsible for the product. The product will be your responsibility from the time we deliver the product to the address you gave us or you or a carrier organised by you collect it from us.

8.What will happen if you do not give required information to us. We may need certain information from you so that we can supply the products to you, for example, address, full name, contact details, etc. If so, this will have been stated in the description of the products. We will contact you in writing to ask for this information. If you do not give us this information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we may either end the contract or make an additional charge of a reasonable sum to compensate us for any extra work that is required as a result. We will not be responsible for supplying or installing the products late or not supplying or installing any part of them if this is caused by you not giving us the information we need within a reasonable time of us asking for it.

9.Issues on Delivery. It is your responsibility to check sizes of item and that it will fit through doors to your room of choice as Lavish Home Interiors will not accept responsibility for damage to property or item, caused trying gain access to the room of choice. If item does not fit Lavish Home will take away items away until you have made arrangements for us to fit item in room. You will be charged for 2nd delivery and may be charged a storage charge for holding item until it can be re delivered. It is your responsibility to make sure items fit into room item is intended to go. If Item does not fit into room, Lavish Home Interiors will not give a refund as it is the customers responsibility to make sure item can fit through the property and Into the room of choice. Item will be left with Customer.

10. Collection by you. If you have asked to collect the products from our premises, you can collect the products from us at any time during our working hours of 10:00 am-5pm on weekdays and Saturdays 10-00am – 5:00pm and Sunday Closed, please call us to arrange this on 01704 530630.

11. If you do not collect the products from us as arranged or if, after a failed delivery to you, you do not re-arrange delivery (if applicable) or collect them from us we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract and clause 12 will apply.

12. We may end the contract for a product at any time by writing to you if: you do not make any payment to us when it is due; you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the products; you do not, within a reasonable time, allow us to deliver the products to you (if applicable) or collect them from us.

13. We may end the contract if you break it. We may end the contract for a product at any time by writing to you if the situations set out in clause 12 apply.

14. The balance of the price for the products must be paid before collection or delivery of the products and in any event within 14 days of notification that the products are ready. We accept payment with all major credit and debit cards, Visa, MasterCard and Paypal.

15. If you do not pay us for the products when you are supposed to (see clause 14) and you still do not make payment within 7 days of us reminding you that payment is due, we may suspend supply of the products until you have paid us the outstanding amounts.

16. Changing your mind. Unless there is a fault with the goods, you will not be entitled to an exchange or refund of products purchased from us ‘in-store’. If you order from us online, over the telephone or from any location away from our shop premise you will be entitled to an exchange or refund, within 14 days after delivery of the products except for in relation to:
i) Custom orders,
ii) On Premise sales.

17. How to tell us about problems. If you have any questions or complaints about the product, please contact us. 18. Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court.
